Terms and Conditions

These Terms of Service (“Terms” or “Terms & Conditions”) govern the package protection service (the “Service”) provided by geicosheild.com. (“GeicoSheild”) to consumers (“you”) of third-party retailers (each a “Brand”), each who engage in the sale, fulfillment, transportation and shipping of orders for merchandise placed through their respective ecommerce channels customers. These Terms apply to the Service and all transactions conducted in connection with the Service.

        1. Terms.

Your access and use of the Service is subject to GeicoSheild’s Terms of Use and GeicoSheild’s Privacy Policy as each may be modified by GeicoSheild in its sole and exclusive discretion from time to time. Through your continued use of the Service following any such modification, you confirm your acceptance of the revised Terms of Use and/or Privacy Policy, including all the terms incorporated therein by reference.

        1. Definitions. 

    2. “Order” means a single order for merchandise placed through a person or Brand’s ecommerce channels that included GeicoSheild.  

    3. “Shipment” means the shipment from a person or the Brand to you of the merchandise included in an Order. For the avoidance of doubt an Order may contain more than one Shipment.

    4. “Person” means the seller or buyer of the merchandise included in an Order.

        1. Sales and Orders. 

    2. All sales, fulfillment, transportation, shipping are conducted in connection are solely transacted between you and the applicable, person or Brand (and not GeicoSheild) from the location of the applicable inventory to the shipping destination that you specify in your order.

    3. GeicoSheild is not a party to any such Order, and GeicoSheild is not responsible or liable for and does not guarantee any representation, warranty or obligation of the applicable Brand to you. Without limiting the foregoing, GeicoSheild is not responsible or liable for any failure of the person or the Brand to complete any transaction, fulfill an order, and/or pay for Order. For the avoidance of doubt, GeicoSheild, including any of its parents, affiliates, and/or subsidiaries, does not make available, produce, provide, sell and/or resell a Brand’s respective product nor provide Order fulfillment, transportation, or shipping Services, and is not a reseller. GeicoSheild makes no representation as to any laws, rules, or regulations of any jurisdiction regarding the production, sale, fulfillment, transportation, and/or shipping of Order to any consumer, including you. YOU HEREBY ACKNOWLEDGE AND AGREE THAT GEICOSHEILD IS NOT ENGAGED IN OR RESPONSIBLE FOR THE PRODUCTION, SALE, FULFILLMENT, TRANSPORTATION, AND/OR SHIPPING OF ORDER, OR ANY COMPLIANCE FOR LAWS, ORDERS, RULES, OR REGULATIONS PERTAINING THERETO. ANY DISPUTES BETWEEN THE APPLICABLE BRAND AND YOU RELATING DIRECTLY OR INDIRECTLY TO ANY PURCHASE OR SALE OF AN ORDER, OR ANY ATTEMPTED PURCHASE OR SALE OF ORDER, MUST BE RESOLVED ENTIRELY BETWEEN THE APPLICABLE PERSON, BRAND AND YOU, AND YOU HEREBY FULLY RELEASE GEICOSHEILD FOR, FROM AND AGAINST ANY AND ALL PRESENT AND/OR FUTURE CLAIMS REGARDING ANY SUCH DISPUTES.

        1. Limitation of Liability

IN NO EVENT SHALL GEICOSHEILD BE LIABLE TO YOU, PERSON, THE APPLICABLE BRAND, OR TO ANY THIRD PARTY FOR ANY LOSS OF USE, REVENUE OR PROFIT OR LOSS OF DATA OR DIMINUTION IN VALUE, OR FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT GEICOSHEILD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE.

      3. IN NO EVENT SHALL GEICOSHEILD’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED THE SERVICES OR THESE TERMS EXCEED THE LESSOR OF (I) $1,000 OR (II) THE ACTUAL AMOUNT PAID BY YOU TO THE PERSON OR THE BRAND FOR THE APPLICABLE ORDER, INCLUDING ANY SHIPPING COSTS. 

      4. GeicoSheild shall not be liable to you unless you provide written notice of the loss, damage, or theft of a Shipment within 7 days of the time when you discover or should have discovered that a shipment was lost, damaged or stolen.

  1. By accepting these Terms, You acknowledge and agree that: (i) GeicoSheild makes no representation as to the legal rights of anyone to ship or import an Order; (ii)  it is the responsibility of the Person, Brand and any shipping provider(s) that it uses to verify your location, identification, and age, and to determine whether it is legal and otherwise safe and appropriate to sell and furnish you with the Order; (ii) GeicoSheild shall not be liable to you for any amount if it determines, in its sole discretion, that a claim is fraudulent. 

  1. GeicoSheild reserves the right to revise these Terms and Conditions at any time for any reason. Except to the extent that your express consent to any revised Service terms is required under applicable law, by continuing to access, browse or use the Service, you confirm your acceptance of the revised Service terms and all the terms incorporated herein by reference. We strongly recommend that you periodically visit this page of Terms of Service to review these terms. If you do not agree to the revised Terms of Service, you may not access or use the Service.
